Terms and Conditions

1. Scope
   These general terms and conditions (AGB) apply to all contracts and services between Tarek Mantaoglu, Peißenbergstraße 19, 81547 Munich (hereinafter "Provider") and its customers for the digital products offered on this website, in particular the Online Admin Tool [Module SCUM] as well as other software and IT services.
2. Contract partner / customer base
   Customers can be both consumers (private individuals) and businesses (companies, associations, organizations).
   By making a purchase, you confirm that you are of legal age and legally competent.
3. Subject matter of the contract and services
   The provider offers digital services and software tools, in particular the Online Admin Tool [Module SCUM].
   Upon purchase, the customer receives access to the respective product for 30 days. After the access expires, it can be purchased again.
   Support services (e.g. help with setup and use) are included during the access period.
4. Conclusion of contract and payment
   The contract is concluded by ordering and payment (e.g. by bank transfer, PayPal, etc.).
   There is no automatic renewal; subscriptions are not offered.
5. Delivery / performance
   Access to digital products or services is activated shortly after payment is received.
   Provision is usually made via online login or download link.
6. Requirements for Use
   To use the Online Admin Tool and the services offered, the customer must have appropriate technical infrastructure (in particular, internet access, a current and compatible browser, and, if necessary, their own server/FTP access data). The customer is solely responsible for meeting these requirements and ensuring their proper functioning.
   Data Retention for Abuse Prevention:
   The provider stores game server IP addresses and email addresses to prevent abuse and ensure the security of the platform. The customer agrees to this data retention as part of using the services.
7. Right of withdrawal for consumers
   Consumers are entitled to the statutory right of withdrawal.
   For digital content (e.g. software, downloads or access), the right of withdrawal expires as soon as the execution (activation, use) has begun at the express request of the customer and the customer is aware that the right of withdrawal expires at the start of execution (§ 356 para. 5 BGB).
   Before activating the digital product, the customer will be explicitly informed and asked for consent.
8. Liability & technical limitations
   The provider is only liable for damages in cases of intent and gross negligence. In the case of simple negligence, the provider is only liable for the breach of essential contractual obligations and limited to the typical, foreseeable damage.
   The provider assumes no liability for data loss, outages, or malfunctions resulting from insecure FTP connections or the customer’s technical infrastructure. The customer is responsible for protecting their own login data and server environments.
   The use of third-party services (e.g., game servers hosted at g-portal.com) is at the customers own risk. The customer is obliged to comply with the respective terms of service and usage policies of the chosen server provider. The provider assumes no liability for violations of such terms or for any misuse of this tool by the customer.
9. Support & updates
   During the active access period, the customer receives support by e-mail. Updates and improvements will be provided where possible.
10. Data protection
    The processing of personal data takes place in accordance with the privacy policy on this website.
11. Final provisions
    German law applies.
    The place of jurisdiction is Munich, if legally permitted.
    Should individual clauses be invalid, the validity of the remaining provisions remains unaffected.

Right of Withdrawal

As a consumer, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the date of conclusion of the contract.
To exercise your right of withdrawal, you must inform me (Tarek Mantaoglu, Peißenbergstraße 19, 81547 Munich, E-mail: mail@tarek.de) by means of a clear statement (e.g. by e-mail) of your decision to withdraw from this contract.

Exclusion or early expiry of the right of withdrawal:
The right of withdrawal expires early if the execution of the contract (activation/use of the digital product) has begun before the expiry of the withdrawal period with the express consent of the consumer and knowledge that the right of withdrawal expires at the start of execution (§ 356 para. 5 BGB).
